REGULATIONS AND GENERAL CONDITIONS
Regulation:

By participating in the event, Operators gain the opportunity to meet selected Buyers with upcoming events of potential interest, through the moments scheduled in the program. To enable Operators to choose which Buyers to meet and to prepare for the appointment with targeted proposals and presentations, the organizational secretariat provides them with all available information pertaining to both the organizers and their scheduled events.

EMI – Eureka MICE International ensures the quality of the Buyers, the accuracy of the information provided, and the organization of the meetings during the event. However, it is not responsible for the outcomes of the meetings and transactions, as these are influenced by factors entirely independent of its operations.

EMI – Eureka MICE International contractually guarantees the Operator a minimum number of appointments with Buyers who have events in planning and are potentially interested in their type of offering. If, during the planning stage, it becomes evident that it will not be possible to guarantee this minimum number, EMI – Eureka MICE International will inform the Operator promptly. In such cases, a refund of €100.00 per missing Buyer will be granted. Should the number of Buyers be fewer than 10, the Operator may decline participation and receive a credit equal to 100% of the fee paid, which can be used for participation in future editions.

EMI - Eureka MICE International guarantees the contacts listed in the Operator's appointment schedule provided upon arrival. In the event of an unforeseeable no-show by a Buyer included in the Operator's appointment schedule, the organization will replace the Buyer with another one, selecting from the Operator's indicated preferences or based on the indications of Buyers who have a schedule targeted to the Operator’s type of product. If replacement is not possible, the Operator, with the contact information and assistance provided by EMI - Eureka MICE International, can still contact the Buyer afterward. In such cases, the Operator will receive compensation equal to 50% of the contact cost as a credit to be used for participation in a future edition.

The guarantee in the previous point does not apply if the failure to meet the guaranteed minimum number of Buyers is due to force majeure, as specified in the General Conditions.

The organizational secretariat provides participating Operators with all legally permissible available information regarding the Buyer and the profile of their organizational activities. Regarding Buyers from the association-congress market, due to their particular nature, personal contact details cannot be provided. Unlike other segments of the MICE market, these Buyers conduct activities completely different from those related to the event and, in most cases, represent non-commercial entities. Therefore, the current privacy laws expressly prohibit the disclosure of sensitive information such as contact details, addresses, and phone numbers by third parties. It is therefore the responsibility of each Operator to directly obtain the relevant contact information from the Buyers of interest for any subsequent direct contact.

Operators are strictly prohibited from contacting Buyers before the workshop. Failure to comply with this rule not only violates the Buyer's privacy but also negatively impacts other colleagues participating in the workshop and harms the organization, which is obligated to protect the confidentiality and privacy of the Buyers. In the event of a confirmed violation of this rule, the Operator will lose the right to participate in the event while remaining liable for the payment of the fees, which will be retained by the organization as compensation for the damage caused.

After paying the fee, and a few days before the workshop, each Operator will be able to view the profiles of the participating Buyers online and will have two working days (48 hours) to select the Buyers they are interested in meeting and notify the organizational secretariat. If no preferences are communicated within this period, the secretariat will schedule the appointments ex officio, taking into account the matches with the Buyer profiles.

Upon completion of the registration at the workshop reception, the Operator will receive their personal workshop agenda, which includes the appointment schedule with the Buyers.

It is the Operator’s responsibility to immediately report to the room assistants if a Buyer scheduled in their appointment agenda does not show up. This will allow the staff to locate the Buyer and bring them to the meeting promptly, or alternatively, arrange a new appointment on the spot. If it is not possible to reschedule the appointment, the organizational secretariat will provide the Operator with all necessary references and assistance to contact the Buyer after the workshop.

The use of data related to both the personal details and all business and program-related references of the participating Buyers is permitted exclusively to the duly registered Operators and solely for purposes related to the Workshop meetings. Any other use is strictly prohibited and will be prosecuted criminally under international Privacy regulations. As far as EMI Eureka MICE International Ltd is concerned, the disclosure of names and/or other references related to the participating Buyers to third parties will be considered an abuse for which compensation will be sought, ranging from €5,000.00 to €150,000.00.
General Conditions

Participation in the event is by invitation only. Only Operators capable of providing proposals in line with the schedules of the participating Buyers are permitted. Eureka MICE reserves the right to reconfirm participation after verifying the stated requirements.

Registration for the Workshop involves completing the participation form and simultaneously paying the required deposit or advance (bank transfer to EMI Eureka MICE International Ltd, Bank of Valletta, Republic Street, Valletta - IBAN MT48VALL22013000000040020496023, SWIFT VALLMTMT).

Registration is finalized with written acceptance by EMI - Eureka MICE International.

The registration fee includes all the services listed in the registration form.

Invoices are issued by EMI Eureka MICE International Ltd, 36, FL3, Abbate Savoia Street, Naxxar NXR1141 Malta. If the Operator is registered in the VIES system, the reverse charge mechanism will apply, and VAT will not be charged. If the Operator is not registered or if it is a company registered in Malta, Maltese VAT will apply.

Once the registration for the event is finalized, the Operator cannot withdraw from the contract.

Full payment is a prerequisite for accessing the online profiles of participating Buyers and attending the event. Without payment, the computer system will not execute the program or schedule appointments. The Operator remains liable for the full registration fee even if they cannot use the appointment program due to late payment.

In relation to the technical, logistical, and organizational needs of the event and to ensure the most advantageous and effective Demand-Supply negotiations for the participating Operators, EMI Eureka MICE International Ltd reserves the right to make changes to the program and to the very methods of conducting the meetings.

Each individual Operator is responsible for their own safety, including health, and for the care of personal belongings, for which adequate insurance is encouraged.

EMI Eureka MICE International Ltd is not responsible for any damages to persons or property incurred by the individual Operator as a result of their participation in the event except for those caused by EMI Eureka MICE International Ltd itself and in particular when:

The act or fault is attributable to the Operator.

The act or fault is attributable to third parties not connected with the provision of services to the Operator, or is unpredictable or unavoidable.

The act or fault is attributable to natural disasters or to causes of force majeure beyond the control of EMI Eureka MICE International Ltd, including (but not limited to) wars, revolutions, riots, unavoidable technical problems with transportation, strikes, airport closures or congestion, terrorist activities, natural or nuclear disasters, pandemics, fires, adverse weather conditions, or unpredictable events.

Unforeseeable Events: EMI Eureka MICE International Ltd and its collaborators are not responsible for damages due to the cancellation, postponement, or reduction, in whole or in part, of the event, as well as for the non-participation of the expected and confirmed Buyers with travel documents (no show) due to reasons beyond their control; the same applies to loss, damage, or delay caused by natural disasters, acts of war, theft, looting, terrorist activities, riots, strikes, military activities, health emergencies, or other circumstances in which it becomes impossible for EMI Eureka MICE International Ltd to ensure the event takes place in the planned manner, time, and location.

EMI Eureka MICE International Ltd cannot be held responsible for any disputes arising with the host country, its sponsors, or other entities concerning any aspect of the event that impact its planning or execution and that may damage the Operator

The Operator authorizes EMI Eureka MICE International Ltd to publish images of themselves and their accompanying persons taken during the event in which they participate.

This document forms an integral part of the application to participate in the event. The application for participation sent by the Operator and countersigned by them indicates the total acceptance of the clauses specified in this document and the current regulations.

COMPETENT COURT – Any dispute or legal issue falls under the jurisdiction of the Court of Malta.
